How to complete a private mortgage closing with Nojumi
If you act for a lender and wish to complete a private mortgage closing, you should take the following steps
Open the Matter
- Create a new private mortgage lending matter
- Generate the Retainer Agreement
- Send the Retainer Agreement to client for e-signing
- Send initial correspondence to the client
Intake
- Complete client ID verification
- Verify Source of Funds with Client
- Share the Closing Form with the client or their mortgage broker
- Complete the Closing Form
- Send email to client and client's mortgage broker asking for contact information of the Borrower's Solicitor
Commitment Letter
- Generate the Commitment Letter
- Send the Commitment Letter to client for e-signing
- Obtain a fully executed Commitment Letter from the Borrower's Solicitor (and a deposit)
- Upload the signed commitment letter to the Upload Bins
Initial Correspondence
- Send the mortgage instructions to the Borrower's Solicitor
- Send an Upload Request to the Borrower's Solicitor to obtain
- Tax Bills
- Payout Statements
- Banking Information
- Send instructions regarding closing funds to the client
Status Certificate Review (if condo)
If the property is a resale condo
- Obtain the status certificate
- Review the status certificate
- Generate the status certificate review report
- Send the status certificate review report to client
Due Diligence
- Complete Title Searches
- Complete Writ Searches
- Determine the outstanding balance for the prior mortgage(s)
- Confirm that all property taxes have been paid by the borrower
Insurance
- Order title insurance (unless the commitment letter sets out that the borrower's lawyer is to order title insurance)
- Instruct the borrower's solicitor to obtain fire insurance, naming the Lender as a loss payee
Invoice and Trust Ledger
- Generate the draft Invoice and the Trust Ledger
- Send the draft Invoice and Trust Ledger to the Borrower's Solicitor
Pre-Closing
- Generate the security documents
- Send the closing documents to the Borrower's Solicitor
- Send Upload Bins to the Borrower's Solicitor to upload the signed closing documents onto
- Generate Form 9D
- Generate the draft charge XML and import into Teraview
- Generate the Acknowledgement & Direction re Charge
- Send the following documents to client for e-signing
- Form 9D
- Acknowledgement & Direction re Charge
- Draft Charge
Registration
- Confirm receipt of the following
- Signed lender documents, including
- Form 9D
- Acknowledgement & Direction signed by lender re Charge (and NAR, if applicable)
- Closing funds from the lender
- Signed closing documents from the borrower
- Title insurance policy
- Fire insurance policy (if not a condo)
- Signed lender documents, including
- Transfer the registration fee from Trust to Special Trust (if applicable)
- Register the charge (and NAR, if applicable) on Teraview
- Wire the closing funds to the borrower's solicitor
Report
- Generate Form 9E and sign it
- Send Form 9E to the client
- Close matter
