We understand the sensitivities surrounding the storage of information and documents by lawyers and law firms and acknowledge that location is a key consideration.

Lawyers often deal with strictly confidential information and documents and cannot afford to be at the mercy of a decision-maker in a jurisdiction with which they are unfamiliar. 

Many Canadian lawyers are concerned with the location of the servers of the cloud services they use as they acknowledge that the location of the data can impact the power a foreign government may have to access the data.

One such example is the United States. While US laws provide multiple levels of privacy protection for individual and enterprise data, including data stored in the cloud, American courts have made it clear that a company with a presence in the United States is obligated to respond to a valid demand for information from the US government. Additionally, US legislations such as the Electronic Communications Privacy Act (“ECPA”) make online service providers that host data subject to compliance with orders under ECPA.

While the Law Society of Ontario doesn't have specific rules with respect to cloud computing, rule 3.3 of the rules of professional conduct provides that a lawyer shall at all times hold all information concerning the business and affairs of the client in strict confidence
