Acting for both Lender and Borrower in a Private Mortgage Transaction

Law Society Rule

Rule 3.4-14 of the Rules of Professional Conduct of the Law Society of Ontario provides that a lawyer may act for both the lender and the borrower in a private mortgage transaction when the total amount of the mortgage does not exceed $75,000.

Mark the Borrower as a Client

  1. Browse the Matter Home Page
  2. Click on Entities
  3. Click on the edit icon for each of the Borrowers
  4. In the modal that opens mark the Borrower as a client
  5. Click on Save

Once the Borrower is successfully marked as a client, the icon next to the Borrower will turn blue to signify that the Borrower has been marked as a Borrower.

You can also click on the Clients only filter to see the clients of the Matter.

    Generate and Sign Consent to Joint Retainer

    To generate the Consent to Joint Retainer, follow the instructions in How to Generate Documents in a Matter and select the Consent to Joint Retainer and generate it.
